How to ensure you meet TCPA and other regulations when reaching out to consumers

The Telemarketing Consumer Protection Act (TCPA) was created by Congress as an effort to protect consumer privacy. Additionally, there are other regulations including the Telemarking Sales Rules (TSR), Truth in Caller ID ACT, and more that regulate who you can call, text, or fax, how and when can do so, and what you can send.


 

How do I make sure I comply with with all contact regulations?

The following guidelines can help you get started. However, we are not attorneys, and you should always verify the latest regulations before completing telemarketing actions.

  • Do not use autodialers, recordings, or simulated voices to make calls to:

    • any residential telephone line using an artificial or prerecorded voice to deliver a message without the prior express consent of the called party.

    • any emergency telephone line or any emergency line of a hospital, medical physician or service office, health care facility, poison control center, or fire protection or law enforcement agency,

    • the telephone line of any guest room or patient room of a hospital,

    • health care facilities, elderly homes, or similar establishments.

    • any telephone number assigned to a paging service, cellular telephone service, specialized mobile radio service, or other radio common carrier service, or any service for which the called party is charged for the call.

  • Provide clear options for customer to opt out of communications they don't wish to receive.

  • Do not contact consumers before 8 a.m. or after 9 p.m. (their local time).

    • Verify state rules, as they vary by state.

  • Provide caller identification in all messages to customers and consumers.

  • Don't spoof call—ensure your caller ID information is accurate.

  • Don't send communications containing false or misleading messages.

  • Don't use ringless voicemail for cold marketing.

  • Do not send unsolicited faxes.

  • Register for a Subscription Account Number (SAN) from the National Do Not Call Registry.

  • Abide by Do Not Call (DNC) requirements:

    • Do not contact anyone on the DNC list.

      • Invelo provides DNC information when skip tracing a contact, but users should always verify this information themselves, as Invelo is not responsible for user communications sent to contacts on the DNC list.

    • Synchronize your lists at least every 31 days.

    • Maintain an internal DNC list of consumers who ask not to be contacted, and don't contact them.

    • Register for all area codes you will be calling.

    • Scrub your call lists against national and state do not call lists.
